im a owner of a small auto repair shop that had a verbal agreement with a small tlme” tote the note” car dealer.ive been doing auto repairs for him for about three years leading up till july 2008.usually payments were made to me 60 to 90 days never in full.one payment might consist of 25 -30 different auto repairs.in july it was very evident he was avoiding me and any attempts to pay his bill.since july ive tried to meet or resolve this issue though him or his office 112 times ive heard i will pay you friday, im in a meeting soon as i get out i will give you a check,my secretary has a check for you,soon as i get back from calif.–bla bla bla–he very much has the little amount he owes me under $5000.00 lot to me.just wont pay and lies,lies,lies.do i have any legal recource or am i beyond the limit on a oral agreement?also he doesnt deny owing the repair money,just doesnt pay.my patience is gone!     Unfortunately, in Arizona small claims court is limited to $2,500 or less. That would have been the way to go. One option is to wait until he brings another car in and put a lien on the car and don’t give it back until he pays in full. Make sure the car is worth at least what he owes you. Contact a lawyer for other options. Once this is settled, don’t do business with him anymore. Also file complaints with the BBB and Chamber of Commerce.
